You must be 18 or older and able to form a binding contract to place orders. You represent that information you provide is accurate.
4. Orders and pricing
Placing an order is an offer to buy. We may accept or cancel orders for reasons including stock availability or pricing errors. Prices shown on the site may change; taxes and shipping are added at checkout.
5. Payment
We accept payments via the site’s secure checkout. By submitting payment information you authorize us to charge the chosen payment method. You must provide accurate billing details.
6. Fulfillment and shipping
We will make reasonable efforts to meet estimated shipping times, but delivery dates are estimates. You are responsible for providing the correct shipping address. For in-store pickup, bring order confirmation and ID.
7. Returns, refunds and perishable goods
Because many of our items are perishable or custom prepared, returns for change of mind are not accepted. If an item is defective, incorrect, or damaged, contact us within 7 days of receipt at [email protected]. We will evaluate and, where appropriate, offer a replacement, refund, or store credit.
8. Accounts
If you create an account, you are responsible for maintaining its security. Notify us immediately of any unauthorized use.
9. User content and images
If you provide files or images for printing or other services, you warrant you own the rights to use them. You grant Pomegranate a limited license to use uploaded materials to fulfill your order and for internal business purposes.

You may not use our site for unlawful or abusive purposes. We may suspend or terminate accounts that violate these terms.
11. Intellectual property
All content on the site is owned by Pomegranate or its licensors. You may not use our trademarks, logos or site content without permission.

Our services and products are provided as is. To the extent allowed by law, we disclaim all warranties, express or implied.
13. Limitation of liability
To the extent permitted by law, Pomegranate’s liability for any claim related to our products or site is limited to the purchase price of the product that gave rise to the claim. We are not liable for indirect or consequential damages.

You agree to indemnify Pomegranate for claims arising from your breach of these terms or your misuse of the site.
15. Governing law
These terms are governed by the laws of the State of New York. Disputes will be resolved in state or federal courts located in New York County, New York.
